2.1 GetYourGuide grants the Supplier access to the Platform to submit their offers (“Booking Offers”) in accordance of Sec. 5 and after approval of GetYourGuide, the Supplier may offer its Services to the Customer. GetYourGuide advertises the Platform and the Services on the Platform.
2.2 The right of the Supplier to use the Platform only exists within the framework of the current technical standard. GetYourGuide temporarily restricts the access to the Platform if this is necessary with regard to capacity limits, the security or integrity of the servers or for the implementation of technical measures and if this serves the proper or improved provision of the Platform (maintenance work). GetYourGuide does not assume any express or implied warranty with regard to the availability of the Platform or its functions or its faultlessness. This also does not include any guarantee that the Platform and the underlying infrastructure are free of viruses and other harmful software.
2.3 Although GetYourGuide makes every effort to ensure the accuracy of the content displayed on or through the Platform. GetYourGuide makes no warranties, express or implied, as to the completeness, accuracy or reliability of the content of the Platform and the suitability of the content for any particular or other purpose (including all third-party information). GetYourGuide reserves the right to change, supplement or remove the contents of the Platform as well as its structure and function at any time and without notice and at its own discretion. Furthermore, GetYourGuide does not guarantee that the contents of the Platform have not been changed by technical defects or by unauthorized third parties.
2.4 The Supplier authorizes GetYourGuide, directly and indirectly through the use of sub-agents, to (a) offer Services to Customers on the Supplier’s behalf, (b) conclude the Customer Agreement in the name of and on behalf of the Supplier, (c) collect payments from Customers for the Services. The Supplier further authorizes GetYourGuide’s third party payment service provider (“Payment Service Provider”) and any other third party authorized by GetYourGuide to process data required to permit the transfer of funds to and from the Supplier’s payment instruments or accounts, or as otherwise required in order to operate the Platform.
2.5 GetYourGuide negotiates the sale of Services between Customers and Suppliers by way of the Platform that contributes to increase the Supplier’s goodwill, promote the Supplier’s Services, and generally encourage Customers to place orders with the Supplier.
2.6 GetYourGuide continuously develops and promotes the Platform, including exploring and implementing further distribution channels, cooperations with relevant providers of digital services and platforms (such as search engine providers), and interfaces to third party products and services (such as digital assistants, web mapping services and search engines, each of which may include further information on listed entities such as geolocation, rankings, payment methods offered etc. and/or allow filtering for different criteria). Thereby, GetYourGuide seeks to further increase the reach of the Platform and to promote the Supplier’s Services directly via the Platform and indirectly via cooperations with distribution partners and via third party products and services, for the mutual benefit of the Supplier and GetYourGuide (see also Sec. 11).
